Terms of Service

The agreement between you and Wiqly.

These Terms of Service (“Terms”) govern your use of the Wiqly dashboard at wiqly.io and the embeddable Wiqly widget served from cdn.wiqly.io (collectively, the “Service”). By creating an account or embedding the widget on a website, you agree to these Terms.

1. Who can use Wiqly

You must be at least 18 years old and capable of entering a binding contract. Wiqly is intended for use by businesses; if you create an account on behalf of a company, you represent that you have authority to bind that company to these Terms.

2. Your account

You’re responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly at hello@wiqly.io if you suspect unauthorised access.

3. The Service

Wiqly provides a dashboard for creating video FAQ widgets and an embeddable script that renders those widgets on your website. We generate avatar videos via a third-party AI provider (HeyGen), store widget configurations and lead submissions, and provide engagement analytics.

We aim for high availability but do not guarantee uninterrupted service. The Service is provided on an “as is” basis; see section 9.

4. Acceptable use

You agree not to use Wiqly to:

  • Create widgets containing illegal, harmful, hateful, defamatory, or sexually explicit content.
  • Impersonate any person or organisation, or misrepresent the identity of the spokesperson character (e.g. claiming an avatar is a specific real person).
  • Spam, harass, or send unsolicited communications to leads captured through the Service.
  • Reverse-engineer, scrape, or attempt to extract source code from the dashboard or widget bundle.
  • Use the Service to compete directly with Wiqly (e.g. building a Wiqly clone using our widget).
  • Circumvent rate limits, plan quotas, or other technical restrictions.
  • Upload or transmit malware, or use the Service to facilitate attacks on third parties.

We may suspend or terminate accounts that violate these rules without notice.

5. Your content

You retain ownership of the scripts, questions, branding, and any other content you create in Wiqly (“Customer Content”). You grant us a limited licence to host, process, and display Customer Content for the sole purpose of providing the Service.

You’re responsible for ensuring you have the right to use any content you upload, including the right to use the spokesperson avatars in the contexts where you embed your widget.

6. Plans, billing, and refunds

Free trial

Paid plans include a 7-day free trial. We collect your payment details at signup but do not charge until the trial ends. You can cancel at any time during the trial from your billing settings to avoid being charged.

Paid plans

Paid plans are billed monthly via Stripe. Subscriptions renew automatically until cancelled. You can cancel at any time from the billing section of your dashboard; cancellation takes effect at the end of the current billing period.

Refunds

We don’t offer pro-rated refunds for partial months. If you believe you’ve been charged in error, email hello@wiqly.iowithin 14 days and we’ll review the case in good faith.

Price changes

We may change subscription prices with at least 30 days’ notice. Price changes take effect at your next renewal.

7. Intellectual property

Wiqly, the dashboard, the widget bundle, the avatar designs, and all related code, design, and trademarks are owned by us. You may not copy, modify, or redistribute any part of the Service except as expressly permitted by these Terms.

8. Termination

You can close your account at any time. We may suspend or terminate your account for material breach of these Terms or for non-payment. On termination, your widgets will stop loading and your data will be deleted within 30 days, except where we’re legally required to retain it (e.g. billing records).

9. Disclaimer

The Service is provided “as is” and “as available”. We make no warranties about uptime, accuracy of generated videos, deliverability of lead emails, or compatibility with every host website’s setup.

10. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to these Terms or the Service in any 12-month period is limited to the greater of (a) the amount you paid us in that period, or (b) £100.

We’re not liable for indirect, incidental, consequential, or special damages — including lost revenue, lost leads, or reputational harm — even if we’ve been advised of the possibility.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under English law.

11. Indemnity

You agree to indemnify Wiqly against any claim arising from content you put through the Service, your use of the Service in violation of these Terms, or your breach of any law in connection with the Service.

12. Changes to the Service or Terms

We may modify the Service or these Terms over time. For material changes affecting your rights or how you use the Service, we’ll notify you at least 14 days in advance by email or in the dashboard. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms is subject to the exclusive jurisdiction of the courts of England and Wales.
